Myth 1: “You have to spend everything before you qualify.” 

This myth keeps many families from seeking help. While Medicaid does have financial limits, you do not have to go broke to receive care. Certain assets are exempt, including your primary residence, one vehicle, and, in some cases, income allowances for a spouse. 

With proper planning, you may be able to preserve significant assets and still qualify for benefits. Tools like irrevocable trusts and spousal refusal strategies are legal, effective, and widely used in New York. 

Myth 2: “Any gifting will automatically disqualify you.” 

Medicaid does have a five-year look-back period for nursing home benefits. This means the government reviews asset transfers and gifts made within the 60 months preceding the application. However, not every gift is disqualifying, and even if penalties apply, they can often be planned for and minimized

Families can still preserve assets by carefully structuring transfers, using promissory notes, caregiver agreements, or properly timed gifts. With the help of an experienced elder law attorney, gifting does not have to mean losing eligibility. 

Myth 3: “You’ll lose all control of your finances once you apply.”
